A new provision quietly added to a federal spending bill is raising concern throughout the hemp industry. Found within the FY2026 Agriculture Appropriations Bill, the language proposes a change to how hemp is defined—specifically by banning any hemp-derived product that contains any quantifiable amount of THC.
While this may sound technical, the effects could be far-reaching for businesses like Pinnacle Hemp and the customers who rely on our products.
What’s Changing?
The current legal definition of hemp, established in the 2018 Farm Bill, allows for hemp-derived products to contain up to 0.3% Delta-9 THC on a dry weight basis. This definition has supported the legal production and sale of products like full-spectrum CBD oils, gummies, tinctures, and more—many of which are formulated to deliver health benefits without intoxicating effects.
The new proposal would remove that allowance and prohibit any hemp product that contains detectable THC. That includes trace amounts naturally present in full-spectrum extracts.
Why This Matters
If passed, this change would ban the sale of nearly all full-spectrum CBD products, even those that are federally compliant, lab-tested, and non-intoxicating.
For Pinnacle Hemp, this would mean:
- Some of our most effective products—including those designed for energy, sleep, and pain support—could no longer be sold.
- Customers who rely on these products for wellness support would lose access to natural alternatives.
- Small hemp businesses like ours could face serious operational and financial setbacks.

At this stage, the bill is still in the early stages of the legislative process. It has not been passed, and many industry voices—including ours—are working to raise awareness and encourage lawmakers to reconsider.
